Construction Law is a branch of the law that covers with issues,
concerns, and questions arising from matters regarding engineering,
construction, and other related fields. Construction law includes commercial
law, contract law, employment law, tort, and planning law. Most of the issues
and concerns that construction law covers regards matters involving contractual
disagreements, negligence, bonds and bonding, liens and security interests,
guarantees, construction claims, and tendering. Parties involved in issues
related to construction law include financial institutions, architects,
builders, surveyors, construction workers, planners, and engineers.
The American Institute of Architects has been promulgating
standard form contracts for the construction industry since 1888. These
contracts are considered to be the norm in the industry and over 200 forms have
been produced. The American Institute of Architects makes changes to the forms
every ten years but they have been accused and criticized for favoring the
owners and architects, rather than serve all parties in the industry. In
response to these accusations that ConsensusDoc Coalition started producing
standard contracts in 2007. Since 2007, 41 trade associations that represent
contractors, subcontractors, design professionals, owners, and guarantees have
joined the coalition.
Michael LeRoy Orlando is one of the three founding partners of FulmerLeRoy & Albee, PLLC and is the managing partner of the firm, which has its
